If you do not agree to any of these terms and conditions you should immediately cease to use the website. Please note that we may close, suspend, or limit your access to your Adhyaapana Education Technology\] account (“Account”) or the Services provided by us on the Site (“Services”), and/or limit/cease access to your funds if you carry out activities which are in contravention of this User Agreement and its associated policies incorporated by reference

1. Changes to Terms of Use

Adhyaapana Education Technology Private Limited reserves the right, from time to time, with or without notice to you, to change these Terms of Use / Terms of Conditions at our sole and absolute discretion. The most current version of these Terms can be reviewed by clicking on the “Terms of Use” located at the bottom of the home page of the Adhyaapana Education Technology Website. The most current version of the Terms of Use will supersede all previous versions. Any such modifications will become effective immediately upon posting to the site and your continued use of the site, Services, and/or Software constitutes your agreement to be bound by such changes. The terms may be modified as frequently as desired and at the company’s sole and absolute discretion. You are advised to regularly visit the “Terms of Use” page to keep yourself updated with our Terms and Conditions to avoid any breach.

2. Modifications to the Service

Adhyaapana Education Technology may add, change or eliminate features, pricing, nomenclature, and other aspects of the Services and make other changes at any time and these Terms will continue to apply to the Services as modified. The Company reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the site or the Services (or any part thereof) with or without notice. You agree that the Company will not be liable to you or to any third party for any such modification, suspension, or discontinuance of the site or the Services. The modifications may be modified as frequently as desired and at the company’s sole discretion.

3. Must be over 18

You must be 18 years of age or older to make online payments at Adhyaapana Education Technology. If you are under 18 you must do the same under supervision of guardian or adult.

4. Registration

To use the website, you will need to register on the site and obtain an account, with your email ID as your user-name and a self-chosen password. You are solely responsible for maintaining the confidentiality of your account(s), and password(s) and for all activities and liabilities associated with or occurring under your account(s), and password(s). You agree that:

(a) information about yourself that you provide will be true, accurate, current and complete (such information being “Your Data”) (b) you will maintain and promptly update Your Data to keep it true, accurate, current and complete (c) you will not use the site, the Services or the Company’s Content to recruit, solicit, or contact in any form subject level experts or potential Customers for employment or contracting for a business not affiliated with us without our advance written permission or authority.

5. Permission of the applicable Trademark owner

We at Adhyaapana Education Technology Private Limited aggressively enforce our intellectual property rights to the fullest extent of the law. You shall not use the Trademarks in any way without our prior written permission.

Cancellation & Refund Policy

By completing your registration for a package and making payment of the fees, you agree to the terms and conditions. You have the right to cancel your booking at any time at the following terms:

Students

ALL REFUNDS to students are made in the form of original payment method.
If a student does not like the tutor after attending a few classes they can change the tutor after filling out a small form explaining the reason for change and will be refunded on a pro rate basis.
Once a student has selected a tutor for a particular class/subject & made the payment, he can cancel the classes at least 3 hours prior to the class scheduled to be held. In case the class is not cancelled before 3 hours of the scheduled class, the class shall be deemed to be convened by default. However, he has to fill out a form explaining the reason for the change.
if the student cancels the classes more than 3 times he/she may be asked to pay a penalty.
Cancellation of classes for the 4th time – a reminder will be sent by the Adhyaapana Education Technology team.
Cancellation of classes for the 5th time – ½ of fees to be deducted
Cancellation of classes for the 6th time – Entire fees shall be deducted and the class will be considered as paid.
Once the booking is done by the student, it is his/her responsibility to attend the class on time.
Rescheduling the class is allowed.
Students

A tutor can cancel his/her classes up to a maximum of 3 times and the action should be taken at least 4 hours prior to the class scheduled to be held. In case the class is not cancelled before 4 hours of the scheduled class, the class shall be deemed to be convened by default and no payment shall be made to the tutor for the class. For any cancellation beyond 4 times, penalty shall be levied.

Cancellation of classes for the 5th time – a reminder will be sent by the Adhyaapana Education Technology team.
Cancellation of classes for the 6th time – ½ of fees to be deducted
Cancellation of classes for the 7th time – Entire fees shall be deducted and the class will be considered as paid.
Tutor/Instructor Rating Policy

The Tutors rating framework in Adhyaapana Education Technology is a combination of technical, business and performance parameters.

The Technical parameter would include:

Educational qualifications – To be evaluated on score (1-5) based on qualification
Professional Experience – To be evaluated on number of years normalized to scale
Awards & Certifications – To be evaluated on score (1-5) based on type and number
Test Assessment – To be evaluated on marks obtained normalized to scale
Interview & Demo – To be evaluated on marks obtained normalized to scale.
The Performance parameters would include:

Student Rating – This would be the average of student rating (criteria for this is explained below)
Class Rating – This would be decided on the quality of classes taken by the tutor (criteria for this is explained below)
Adhyaapana Education Technology Internal Rating – This would be the average of Adhyaapana Education Technology rating. The (Criteria for this is explained below)
A Adhyaapana Education Technology tutor will be awarded 4 levels – Platinum, Gold, Silver & Bronze. These will be based on the weighted average of the above technical, business and performance parameters. Adhyaapana Education Technology will determine the weight given to each parameter (technical, business or performance).

A Adhyaapana Education Technology tutor’s overall rating will be altered at the end of every week.

Below are the student, class and Adhyaapana Education Technology internal rating criteria that will form the performance parameter:

Payment Information

By completing your registration for a package/class and making payment of the fees, you agree to the terms and conditions. You have the right to cancel your booking at any time at the following terms:

I. Students’/ Tutor’s Fee Payment Mechanism

1. The students are required to make payment only through Adhyaapana Education Technology Payment system which involves payment to Adhyaapana Education Technology Private limited.

Different modes of payment that can be used to pay to Adhyaapana Education Technology:

Pay using Net banking
Pay using credit card/ debit card
Pay using Paytm Wallet
Other modes through prior intimation and confirmation by Adhyaapana Education Technology officials only
QR Code-based payments
Other facilations provided by our payment gateway partner.
2. Prior to each class being given, the student has on file with Adhyaapana Education Technology a valid form of payment

This includes a valid credit/debit card or Paytm account, or a positive balance of prepaid tutoring credit. After selection of the tutor and demo class, if required, is taken the students select the package and shall make the payments at the beginning for the package he/she chooses. The requirement to verify payment information must be followed for continuing students as well as new students.

II. Tutor payment policies

By registering as a tutor with Adhyaapana Education Technology (“the website,” “website,” “adhyaapana.com”), you (“tutor”) agree that the following terms and conditions will govern all payments made to you by students through the Adhyaapana Education Technology system.

Conditions for guaranteeing receipt of payment for student class

Adhyaapana Education Technology helps in bringing together those seeking tutoring services with those who seek to provide tutoring services. Adhyaapana Education Technology also provides a service to its users, whereby the payments will be distributed to tutors originated from their students. Adhyaapana Education Technology offers tutors a layer of protection in the collection of their funds but, if any of the following conditions are not met and Adhyaapana Education Technology becomes unable to collect your payment from the student, or other type of account-holder (collectively, “student”) to whom you gave a class, Adhyaapana Education Technology cannot guarantee that your payment will be successfully collected, processed and distributed to you:

1. The information pertaining to the class is updated to Adhyaapana Education Technology

After completing a class, the tutor is required send an email to admin team.

Note: Payments will be processed only after a class is closed.

2. The class is delivered in-person at a mutually agreed upon location or through Adhyaapana Education Technologys’s online tutoring platform.

Classes can only be given through online

ONLINE: Only through Adhyaapana Education Technology portal.

Any other mode of conducting classes outside the mentioned mode shall not be recognized by Adhyaapana Education Technology and no payment shall be made for such classes.

3. Tutor enters into a Memorandum of Understanding subject to renewal every year.

4. The tutor’s services are instructive and constitute learning, not cheating. More specifically, the tutor is not to complete assignments, write papers, take quizzes or otherwise do work on the student’s behalf. Further, the services that the tutor offers must not violate the academic honesty policy or other conduct policies of the student’s school, university, academic institution or workplace.

5. A tutor can cancel his/her class up to a maximum of 4 times and the action should be taken at least 4 hours prior to the class scheduled to be held. In case the class is not cancelled before 4 hours of the scheduled class, the class shall be deemed to have been convened by default and no payment shall be made to the tutor for the class. For any cancellation beyond 4 times, penalty shall be levied. Please refer Cancellation Policy for the same.

6. Prior to a class being given, the tutor has received Adhyaapana Education Technology’s subject approval for the specific subject area of the class.

7. The tutor does not collect or request payment directly from the student by cash, cheque or otherwise, for the class. Payment to tutors shall be made through online mode only.

8.Timing and delivery of payments

If all the Conditions for guaranteeing receipt of payment for student class are met, tutors can expect to receive their funds according to the following schedule. If there are questions about any of the conditions, payments may be delayed while Adhyaapana Education Technology attempts to resolve the questions.

A tutor shall be paid by account transfer only. (Payments shall be made at the bank account details provided by the tutors during the registration process or after certification from Adhyaapana Education Technology. For any amendment, tutor may separately inform Adhyaapana Education Technology.) RTGS/ NEFT transfers will be affected by the 7th day of each month or the following business day in case of weekends and bank holidays. In order for a class payment to be included in a particular pay period, that class must be entered 5 days prior to the payment date.

9.Calculation of tutor payment amounts

a) Tutors set their own Budget matrix- The tutors can set their budget on the basis of per class.
b) All tutors agree to the following commission structure. Adhyaapana Education Technology will charge a commission @ 25% plus any taxes as may be applicable as per Government rules, on every payment for a class arranged between the student and the tutor.
c) Non-tutoring charges should be incorporated into the hourly rate. Travel, parking, prep time, or other expenses that you wish to defray to the customer must first be agreed to by the student. The mechanism to assess these charges is to adjust your hourly rate. Under no circumstances should the tutor receive payments directly from the student, on any account.

Understand that anyone who is able to commit identity theft can also falsify a profile, so we suggest you take the following steps for your own protection.

Review student feedback

Look at the Student Feedback section of the tutor profile to see lesson ratings (1 to 5 stars) and student reviews from previous customers. You are also free to request outside references from the tutor.

Have an adult present

Adhyaapana Education Technology certified Tutor/instructor goes through a 4 step rigorous teacher scrutiny process which includes an Online/ Offline interview with our team and a full background check conducted by our external partners. It is advised that an adult should always be present for tutoring sessions if the student is under the age of eighteen.

Keep personal information private

Never include your last name, e-mail address, home address, phone/ mobile number, place of work, or any other identifying information in initial e-mail messages or communications. Stop communicating with anyone who pressures you for personal or financial information or attempts in any way to trick you into revealing it. Do not exchange personal contact information until you are completely comfortable and until you have payment information on file with Adhyaapana Education Technology.
